Terms and Contracts

ABOUT THE TERMS
Skazee is always looking for satisfaction and good relationships with our customers, so the Terms and Conditions are necessary so that we can provide the best service possible. Failure to comply with any of the clauses or conditions will be grounds for the immediate deactivation of the account without any notification. Activity that results in the suspension or deactivation of an account will result in the loss of all fees already paid. Complaints made regarding account abuses will be investigated and if the culprits are found it will be grounds for immediate suspension. When Skazee becomes aware of a rule violation, we will initiate an investigation. During the investigation, we may restrict the client's access to ensure the legitimacy of the data. Depending on the severity of the breach, Skazee may restrict, suspend or even terminate the hosting account or use civilian means. If the violation constitutes a criminal offense, Skazee will notify the legal authorities. Skazee will not have credit for service interruptions resulting from violations of this term. To report suspected abuse or any violation of these standards, please contact our responsible department via the contact page. Skazee's services are provided in a natural way. Skazee disclaims any guarantee that the service will be error-free, secure or uninterrupted. No oral or written information by Skazee, or its licensees or the like, will create a warranty. Skazee and its distributors will not be responsible for any cost or damage arising directly or indirectly from any transaction or use of the service.
HOSTING OF SITES
The Website Hosting services cannot be used, under any circumstances, to store any type of backup. It is not allowed to use the contracted hosting as a virtual disk. Upload-style sites (such as RapidShare, Mega, etc.) are not allowed. The content of each Hosting account must be strictly linked to the functioning of the website itself. Any content not related to the functioning of the website is in breach of our agreement and is liable to be removed without notice. Plans on shared servers cannot be used as a mirror for program or application updates, even if the user is the systems developer.
- CHANGE IN THE PLAN / PAYMENT:
  It is possible to change the payment plan and periodicity through the Skazee Panel through the Products menu. It is not possible to change the product if the invoice for the next cycle has already been generated, and the change is possible after payment of the open invoice related to the product. If the upgrade or downgrade is made, the amount will be offset based on the new plan chosen.
ILLEGAL USE
Skazee's servers must be used for legal purposes. Transmission, storage or distribution of any information, data or materials that violate any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, obscene, defamatory, prescribed drug and material sales that constitute an illegal threat or violate export control laws, the laws of the state of Florida in the United States, or the laws of Brazil. Examples of unacceptable content or links: Pirated software, pyramidal financial scheme, hacker programs or files, Warez sites and IRC bots. The subscriber to the Skazee service agrees to indemnify and hold Skazee liable for any claim resulting from the use of this service that harms the subscriber or any other interested party. Online pharmacies are not allowed in our network, as well as sites related to High Yield Investment Programs, the English High-Yield Investment Program - HYIP, Ponzi scheme or pyramid schemes are prohibited. Cooperative system of "Snowball" is prohibited, where the person is led to believe that in the purchase of a ticket of small value, he / she can win a large amount, by inducing other people to purchase tickets, so that when his quota ends ticket sales will be awarded.
BACKUP
You can generate and download full or partial backups of your files and emails through cPanel > Backups. It is recommended that you always keep a backup of your files.
SPAM
Spamming, or sending unsolicited emails in bulk, from or through Skazee servers or using email that is hosted on a Skazee server is strictly prohibited. As a preventive measure, our shared servers block access to external SMTPs for applications (scripts) that are not part of the OS's email system, thus preventing malicious people from using our servers as intermediaries for sending SPAM. Those who violate will have a fine of $300.00, without prejudice to the immediate cancellation of the service. Dedicated service customers will be solely responsible for actions originating from their respective servers. The addition of any of the server's IPs in spam lists (blacklists) will result in a fine of $200.00 (for blocked IP) to the person responsible for it. The identification of problems caused by the excessive and constant reception of spam for a given domain hosted on shared servers will result in the cancellation of the service.
PAYMENT
You agree to pay for all products you purchase, and that Skazee may charge you. You are responsible for the timely payment of all charges and for providing Skazee with a valid credit card as well as valid financial details. You agree that it is your duty to access the financial area to see if there are any outstanding payments. Our system sends monthly open payment notifications as a way to keep you informed about your account status, but for various reasons this email may, at some point, not reach your address. Therefore, it is extremely important to make the act of accessing your customer area a habit to prevent your account from being suspended due to non-payment. After 5 days without payment compensation, the invoice will have an increase of a fine of 4% / month of its value. Within 6 days of the expiration date, your account may be suspended.
- SMS PAYMENT:
  Payment must be made before the due date using the payment methods in force at the time, the customer being responsible for paying the fees, if applicable, of the payment portals.
REFUND
Refunds for hosting sites are allowed up to 7 days after the date of contract with full refund of the amounts paid. Reimbursement for domains and certificates is not possible because it is a product registered with external companies, making reimbursement impossible. SMS packages also have no partial or full refund.
PROMOTIONS
- WELCOME PROMOTION:
  Get 7 days free on any plan by subscribing monthly. Promotions valid only for new subscriptions. The customer must use the discount code on the "hosting" page to grant the discount on the cart. It will not be possible to use after paying for the service. Promotion cannot be combined and cannot be combined with any other promotion. - FREE DOMAIN PROMOTION:
  You will receive a free international domain of up to R $ 69 per year paid in the PRO plan. If the customer cancels the plan or downgrades before the end of the payment cycle, the current value of the domain will be proportionally discounted on the refund. For the promotion to be valid, it is necessary for the user to use the discount coupon (available on the product page) in the cart before finalizing the purchase, and it is not possible to apply the discount later. Promotion valid for an indefinite period, being possible to finish at any time. Promotion valid for new subscriptions and domain registration only.
- PROMOTION 10% OFF SSL:
  Get 10% off selected security certificates (Sectigo Positive SSL, Sectigo EV SSL, Sectigo PositiveSSL Wildard and RapidSSL Standard). For the promotion to be valid, it is necessary for the user to use the discount coupon (available on the product page) in the cart before finalizing the purchase, and it is not possible to apply the discount later. - PROMOTION SECTIGO FREE SSL:
  One year of free Comodo Positive SSL certificate will be given to new subscribers of the "Pro" hosting plan in the quarterly, half-yearly and annual payment cycles. The certificate will be activated by the Skazee team and can only be used on Skazee hosting, and it is not possible to use it on any other server, under penalty of canceling the certificate. The certificate must be requested through a ticket to be requested, after requested the certificate will be issued within 5 days. In order to use an SSL certificate, a dedicated IP is required and must be signed before enabling SSL. If the hosting plan is canceled, the certificate will also be canceled. Promotion valid for an indefinite period, being possible to finish at any time. Promotion cannot be combined and cannot be combined with any other promotion.
- PROMOTION VIP:
  Get a 3% discount on Skazee products (website hosting, domains, security certificates, design plans and extras). The "VIP" benefit will be given to customers who purchase the Pro hosting plan in the annual payment cycle and also to subscribers of the 6 or 12 month design plans. The VIP lasts for 1 year. Promotion valid for an indefinite period, being possible to finish at any time.
SMS
SMS packages have no valid term, so they can be sent at any time. Packages can be purchased through the website Skazee.com and will be managed and sent via the Panel with login and password accessible through Skazee.com/enviosms.
It is prohibited to send sms with illegal content, such as phishing or spam. Sending SMS in this way will cause the cancellation of your service without prior notice and loss of any SMS balance available in your account, without the right to partial or full refund.
CANCELLATION
If you want to cancel your service, you need to do this 10 days in advance of your subsequent charge. If your cancellation request is not received by this time, you will be responsible for paying the following month and will be subject to disabling the service without notice. Accounts suspended for more than 30 days will be automatically removed without prior notice (except in cases where the customer contacts him stating that he wants to temporarily disable it). For each monthly invoice created, at least one reminder will be sent, in addition to the creation email as a way of reminding you that there are open payments and, consequently, preventing your account from being removed. Cancellation requests must be made through your account on our (customer's) Panel.
ABUSE AGAINST OUR TEAM
Abuse against our team will not be tolerated. If you use aggressive language, threaten us, or otherwise offend us, then we may suspend your account, or delete it without offering a refund. Treating our team with low-level words or in general, mistakenly, will be grounds for notification of contract cancellation. We reserve the right to refuse, cancel or suspend the service at our sole discretion.
CHANGES TO TERMS
Skazee reserves the right to add, delete or modify any provision of this term at any time. You agree that you will undertake to adjust to these changes, should they occur. If you purchased a service or product with Skazee, the above terms will continue to apply as long as you are an active customer. You agree that you will be responsible for notifying Skazee when you wish to cancel a service or product. This notification must be sent 5 days in advance of its due date.
UNMETERED/UNLIMITED POLICY
- Definition of Shared Website Hosting:
  At Skazee, all hosting plans are what are defined as “shared website hosting”. Shared hosting aims to divide the resources of a large server between several sites, reducing costs for customers. On a server of this type, with several sites sharing resources, if a site starts to consume too much memory or CPU, regardless of the reasons, all other sites will experience the effects, which can translate into slow access or availability failures . For this reason it is very important that your website uses good programming practices, both in terms of performance and security, which are inherent characteristics of the quality of the code. When we detect a website in these conditions, we analyze the reasons for the increase in excessive consumption and suggest the most appropriate ways to resolve it, whether by migration, optimization of the schedule and so on.
- Definition of space and transfer:
  To allow a better understanding of the term “unlimited” applied to space and transfer, we define “space” as the amount of data written to disk, code files, images, videos and the like. In all cases, “transfer” is the amount of data transferred between our servers and the legitimate visitors / users of your sites. Therefore, “unlimited” means that there are no restrictions on the amount of space consumed by visitors / users accessing your site as well as data transfer. As a consequence, there will be no additional charge in this regard. All contractual clauses currently in force and which are not related to space and transfer limits are fully maintained. In case of doubts about the application of the contract or this promotional advertisement, the provisions of the contract shall prevail. For this reason, having unlimited space and transfer does not mean that you can use your hosting in a way that could impair the functioning of the server, for illicit purposes or in any other way contrary to the legislation in force. If this happens, the appropriate measures will be taken as described in the contract.
- What is not allowed in UNLIMITED:
  It will not be allowed, for example: The use of hosting as a virtual disk, that is, as space for storage or backup of files that are not elements of your site. For this purpose, other products can be used such as the various options of Cloud Computing or Dedicated Servers. The purpose of a Website Hosting is to have only web sites, since we already provide the service to backup your own site.
  Hosting of films, TV series, music, applications or any type of copyrighted material, characterized as “piracy”, stored in any file format or extension. The use of hosting as a “mirror” of other sites, neither to serve as upload server in the style of sites like “Zippyshare” or “Mega”, or the use as a mass distributor of large multimedia - and in this case the products most suitable are definitely dedicated servers or Cloud Computing. Making your login and password data available to the Control Panel, SSH, FTP to the public - for example, in forums, mailing lists, chat channels, other sites - in order to share files with the general public .
  For MySQL, PostgreSQL and SQL Server databases, the accesses considered legitimate are those made from your website, hosted on Skazee. External, direct access to the database is limited and restricted to a maximum of 1 simultaneous connection (for the purposes of database administration). Accesses coming from your website / application are not limited. The MySQL, PostgreSQL and SQL Server databases cannot be used by sites / applications or tools that are not part of your hosting plan and / or are hosted outside Skazee.
- Server Limits for Shared Hosting Accounts:
  - 10% CPU usage;
  - 512mb of RAM;
  - 50 simultaneous data connections at the same time;
  - 150,000 total inodes;
  - 250 emails sent every 60 minutes (all excess messages will be discarded and not delivered);
